1. Agreement to Terms

By accessing or using Wise Steward's website and application at wisesteward.app (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

The Service is operated by Wise Steward (“we,” “our,” or “us”), based in Post Falls, Idaho, United States.

2. Description of Service

Wise Steward is a personal finance management platform that helps users track, manage, and optimize their finances. The Service includes:

  • Financial account aggregation via Plaid
  • Automated transaction categorization
  • Budgeting tools
  • Investment and net worth tracking
  • Receipt scanning and organization
  • AI-powered financial insights
  • Tax preparation assistance

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By creating an account, you represent and warrant that you meet these requirements.

4. Account Registration

You must create an account to access the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for safeguarding the password and credentials used to access your account and for any activity that occurs under your account. You agree to notify us immediately at security@wisesteward.app if you suspect unauthorized access to your account.

5. Subscription and Payment

5.1 Pricing

The Service is offered on a paid subscription basis. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice to existing subscribers.

5.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). Payment is processed through Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

5.4 Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

6. Financial Data and Third-Party Services

6.1 Plaid

By connecting your financial accounts, you authorize Wise Steward to use Plaid to access your financial data from your financial institutions. Your use of Plaid is subject to Plaid's End User Services Agreement.

6.2 Data Accuracy

While we strive to display accurate financial data, we depend on third-party data sources (your financial institutions and Plaid). We do not guarantee the accuracy, completeness, or timeliness of financial data displayed in the Service. You should always verify important financial information directly with your financial institutions.

7. Not Financial Advice

Wise Steward is a financial management tool, not a financial advisor. The Service provides information, tools, and AI-generated insights for informational purposes only. Nothing in the Service constitutes personalized financial, investment, tax, or legal advice.

You should consult with qualified professionals before making financial decisions. We are not responsible for any financial decisions you make based on information provided by the Service.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or its related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malware or other harmful code
  • Interfere with the security or integrity of the Service
  • Share your account credentials with others or create accounts for third parties without authorization
  • Use automated systems (bots, scrapers) to access the Service without our written permission

9. Intellectual Property

The Service, including its design, code, features, and content, is owned by Wise Steward and protected by United States and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

Your financial data remains yours. We claim no ownership of your personal or financial information.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Wise Steward and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Errors or inaccuracies in financial data displayed by the Service
  • Financial decisions made based on information from the Service
  • Any third-party conduct on or related to the Service

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

13. Indemnification

You agree to indemnify and hold harmless Wise Steward and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

14. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in activity that could harm the Service or other users. You may delete your account at any time.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Kootenai County, Idaho, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
